Connecticut’s Time’s Up Act Harassment-Free Training Deadline Extended to January 1, 2021

Pursuant to Executive Order 7DDD, as amended by Executive Order 9A, the October 1st Connecticut Sexual Harassment Prevention Training deadline has been extended to January 1, 2021, due to the Covid-19 Pandemic. This is a blanket extension and does not require a request to be made.  

As we wrote earlier this month, the prior deadline of October 1, 2020, was extended but only for those businesses which filed an extension request by September 9th. This new Executive Order makes the 90 day extension automatic for all businesses regardless of whether they filed for an extension before the prior September 9th deadline. 

Sexual Harassment Training Mandate

In the 2019 legislative session, the Connecticut General Assembly passed and the Governor signed Public Acts 19-16 and 19-93 , which together constitute the Time’s Up Act – the law that mandates sexual harassment training for almost all employees.  This made Connecticut one of only a handful of states that mandate such training.   This legislation required providing almost all employee with sexual harassment training and education. The old law only mandated certain supervisors be trained.  These new changes went into effect October 1, 2019. The new mandates, which applies to employers with three or more employees, includes: 

  • Employers must provide to a new employee a copy of information regarding the illegality of sexual harassment and remedies available to victims. 
  • Employers must provide all existing employees with two hours of sexual harassment training by October 1, 2020. 
  • Employers must provide two hours of training and education to new employees hired on or after October 1, 2019, within six months of their start date. 
  • Employers with fewer than three employees must provide two hours of training and education to all existing supervisory employees by October 1, 2020, or within six months, to new supervisory employees. 
  • Employers must provide periodic supplemental training not less than every ten years.
