Although the proposed increases to the federal white-collar exemptions never got off the ground, that does not mean New York employers are off the hook – they must still comply with the set of increases mandated by the State a few years ago. These increases will be fully implemented within the next few years. The latest round goes into effect on December 31, 2018.
The increases apply to employees classified as filling “executive” or “administrative” roles. In order to be properly classified as exempt under current standards, employees must satisfy both a duties test and salary threshold. While the duties test remains unchanged, the salary threshold will generally increase year after year to keep up with inflation, until eventually levelling out by 2020. The exact threshold varies by employer size and location within the state. The thresholds for 2019 are:
- Large employers (eleven or more employees) in New York City – $1,125.00 per week.
- Small employers (ten or fewer employees) in New York City – $1,012.50 per week.
- Employers in Nassau, Suffolk, and Westchester Counties – $900.00 per week.
- Employers in the rest of New York State – $832.00 per week.
