New Model COBRA Notice Available

As most employers know, employers offering group health insurance and employing twenty or more employees must allow terminated employees, spouses, and beneficiaries the option to continue their coverage at the group rate under the Consolidated Omnibus Budget Reconciliation Act (COBRA).  The law also requires employers notify employees, spouses, and beneficiaries after a qualifying event, like termination, with notice of their right to elect such coverage.  The federal Department of Labor (“DOL”) provides model notices and model election forms.  These forms have recently been updated to include, among other things, the right of employees to enroll in health insurance on the Marketplaces created under the Affordable Care Act.  Use of these notices is not required but it is recommended.  Copies of these revised model notices are available on the DOL’s website at http://www.dol.gov/ebsa/COBRA.html.
