The Equal Employment Opportunity Commission has revised its “EEO is the Law” poster to include notices required by the new Genetic Information Nondiscrimination Act (“GINA”) which goes into effect November 21, 2009. GINA protects applicants and employees from discrimination based on their genetic information similar to the way Title VII protects against race, sex, national origin, and religious discrimination. The new poster also contains changes to the Americans with Disabilities Act which went into effect January 1, 2009.
While not all employers are required to post each of the federal posters (this depends on the employer’s size), most employers post the Federal “5 in 1” poster. For those employers whose size excuses some of these postings, they should literally cut out the unneeded posting so as to not mislead employees into thinking an employer is covered by a law that does not apply. To make your current postings current, Employers can either replace their existing poster with the new one, or post the supplemental poster along with their existing poster (dated September 2002).
