A revised Form I-9 was recently approved by the Office of Management and Budget. The new version is expected to be published by November 22, 2016. The current version of Form I-9 will continue to be acceptable until January 21, 2017. After this date, employers will be required to use the new form.
Do not get caught using an outdated version of Form I-9. Fines for Form I-9 infractions can sometimes be very steep. Of course, it may be a good idea to conduct a Form I-9 audit to ensure all your practices are up-to-date and compliant. However, such an audit must be done lawfully. You should consult competent employment counsel before attempting one. We will continue monitoring the situation and will provide an update when the new form is available.
