Changes to FMLA Poster and Forms Go Into Effect

Last month, the United States Department of Labor (“DOL”) issued new regulations changing Family and Medical Leave Act (“FMLA”) eligibility for leave related to members or veterans of the military and leave for airline flight crew employees.  The DOL also updated its mandatory workplace poster and optional employer forms to reflect some of the changes.

Employers covered by the FMLA must post the new poster immediately.  The employer forms are optional, but are recommended to ensure compliance as employers may ask for only limited information regarding employee illnesses.  There is also a brand new form for leave to care for veterans.  While employers can use their own forms, they should not ask for information not requested on the official forms.
