New York Minimum Wage Going Up Again – Are You Ready?

New York’s minimum wage will go up again at the end of the year as part of the schedule which went into effect several years ago.  The amount of the increase will vary depending on the employer’s size and location.  The new minimum wages are:

  • Large employers (eleven or more employees) in New York City – $15 per hour.
  • Small employers (ten or more employees) in New York City – $13.50 per hour.
  • Westchester and Long Island employers – $12.00 per hour.
  • The rest of New York State – $11.10 per hour.

The minimum wage for fast food workers is also going up, but on a different schedule:

  • New York City – $15.00 per hour.
  • The rest of New York State – $12.75 per hour.

Determining who qualifies as a “fast food” worker can be tricky.  For instance, this law applies only to “fast food establishments” which are part of a chain.  “Chain” is a term of art with a specific meaning – New York’s Hospitality Wage Order defines it as “a set of establishments which share a common brand, or which are characterized by standardized options for décor, marketing, packaging, products, and services.” 

New York employers should be aware of these increases and ensure they are in compliance.  Employers unsure of whether the fast food minimum wage schedule applies to their workers should seek advice from competent labor and employment counsel.
